Winter Parking Restrictions Ordinance

ORDINANCE NUMBER 11-01

CITY OF DOVER

An ordinance prohibiting parking on City streets during snow removal.

THE CITY COUNCIL OF THE CITY OF DOVER HEREBY ORDAINS: 

WINTER PARKING RESTRICTIONS

It shall be unlawful to park or allow any motor vehicle or trailer to remain parked on any City street or alley so as to obstruct the removal of snow therefrom. It shall be presumed that any motor vehicle or trailer remaining on a street or alley for 24 hours after which two(2) or more inches of snow have accumulated, is in violation of this provision. Any peace officer or employee of the City involved in snow removal is hereby authorized to remove from City streets and alleys any such vehicle or trailer obstruction removal of snow by tagging, towing, impounding, and storing it.  The registered owner of the vehicle may redeem it upon payment to the City Clerk of the cost of such towing, impoundment and storage. It shall be presumed that the owner of the vehicle was aware of its location and the obstruction of snow removal. A violation of this provision shall be a misdemeanor regardless of whether or not the vehicle was towed.

This ordinance shall be effective upon publication.
